Consent to Collection, Use, and Disclosure of Personal Information

Purpose of This Consent Form

This Data Access Consent Form describes how HyreMynd AI Inc. ("HyreMynd," "we," "us," or "our") collects, uses, and discloses your personal information when you use our AI-powered psychometric assessment platform. By providing your consent below, you authorize us to process your personal information as described herein.

1. Who We Are

HyreMynd AI Inc. is a Canadian corporation providing AI-powered psychometric assessment services to employers ("Enterprise Customers"). Our platform analyzes assessment responses and resumes to generate behavioral trait profiles that help employers make informed hiring decisions.

2. Information We Collect About You

We collect the following categories of personal information:

A. Information You Provide Directly

  • Contact information (name, email address, phone number)
  • Account credentials
  • Resume/CV content, including employment history and education
  • Responses to psychometric assessment questions

B. Information Generated Through Assessments

  • Behavioral trait indices and profiles (including ODI, API, RCI, AII, SDI, RRI)
  • Assessment scores and recommendations
  • AI-generated insights derived from your responses and resume

C. Technical Information

  • IP address and device information
  • Browser type and operating system
  • Session and interaction data

3. How We Use Your Information

We use your personal information for the following purposes:

  1. Assessment Delivery: To administer psychometric assessments and generate your behavioral trait profile
  2. Employer Sharing: To share your assessment results with prospective employers who are evaluating your candidacy
  3. Resume Analysis: To analyze your resume using AI technology for matching and screening purposes
  4. Account Management: To create and manage your account on our platform
  5. Platform Improvement: To improve our services and develop new features
  6. AI Model Training: To train and improve our AI models using de-identified data (see Section 6)

4. Use of Artificial Intelligence

How AI Is Used

HyreMynd uses artificial intelligence to analyze your assessment responses, generate behavioral trait indices and profiles, analyze resume content for matching purposes, and provide insights to prospective employers.

Important: Human Decision-Making

Important: Our AI does not make employment decisions. AI-generated scores and recommendations are provided to prospective employers to inform their decision-making. The final decision to hire, reject, or take any employment action rests solely with the employer. You have the right to request human review of any AI-generated assessment that significantly affects your candidacy.

Proprietary Technology

The HyreMynd assessment engine is proprietary technology, patent pending with the Canadian Intellectual Property Office (Application No. 3293113). Information about AI logic and decision-making factors will be provided to the extent required by applicable law, subject to protection of trade secrets and intellectual property rights.

5. Third-Party Platform Integrations

HyreMynd integrates with third-party platforms to enhance our Services. When you authorize connections, we may collect and share data with:

  • LinkedIn: Professional profile data, employment history, education, and skills
  • Calendly: Scheduling and availability data for interview coordination
  • Other Platforms: Applicant tracking systems (ATS), HRIS, job boards, and other recruitment tools

You control which integrations are active and may revoke access at any time through your account settings.

6. Disclosure to Prospective Employers

By consenting below, you authorize HyreMynd to share the following information with prospective employers who have engaged our services: your assessment results and behavioral trait profiles, your resume content and AI-generated resume analysis, and your assessment scores and recommendations. Employers use this information solely to evaluate your suitability for employment opportunities.

7. Data Retention

Retention Period

We retain your personal information for the duration of your active account, plus three (3) years following account termination or your last interaction with our platform.

De-Identified Data

If you request deletion of your personal information, we will remove all data that can identify you. However, de-identified data—information that has been stripped of personal identifiers and cannot reasonably be used to identify you—may be retained to train and improve our AI models. This benefits all platform users by enhancing assessment accuracy and fairness.

8. Your Rights

You have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request correction of inaccurate or incomplete information
  • Deletion: Request deletion of your personal information (subject to legal requirements)
  • Withdraw Consent: Withdraw your consent at any time (this will not affect prior processing)
  • Human Review: Request human review of AI-generated decisions that significantly affect you

Additional Rights for Quebec Residents (Law 25)

If you are a Quebec resident, you have additional rights under Law 25:

  • Data Portability: Receive your personal information in a structured, commonly used format
  • De-Indexation: Request that we cease disseminating your information or de-index hyperlinks attached to your name
  • Automated Decision-Making: Be informed when decisions are based exclusively on automated processing and object to such processing
  • Complain to CAI: File a complaint with the Commission d'accès à l'information du Québec

9. Cross-Border Data Transfers

Your personal information may be transferred to, stored, and processed in Canada and the United States. We ensure appropriate safeguards are in place to protect your information in accordance with applicable privacy laws, including PIPEDA (Canada), Quebec Law 25, and applicable U.S. state laws. In accordance with Law 25, we inform you that your personal information may be communicated outside Quebec, and we have conducted the required privacy impact assessments for such transfers.

10. Withdrawal of Consent

You may withdraw your consent at any time by contacting us at [email protected]. If you withdraw consent, you will no longer be able to use our assessment services, your assessment results will no longer be shared with prospective employers, and we will delete your personal information in accordance with our retention policy (de-identified data may be retained as described in Section 6).

By signing below (or by clicking "I Agree" on the electronic version), I acknowledge and confirm the following:

  1. I have read and understood this Data Access Consent Form and the HyreMynd Privacy Policy.
  2. I consent to the collection, use, and disclosure of my personal information as described herein.
  3. I consent to my assessment results and resume analysis being shared with prospective employers.
  4. I consent to HyreMynd collecting data from third-party platforms (such as LinkedIn, Calendly, and other integrated services) when I authorize such connections.
  5. I understand that AI technology is used to generate my assessment profile and that the final employment decision rests with the employer.
  6. I acknowledge that the HyreMynd assessment engine is patent-pending proprietary technology (CIPO Application No. 3293113) and that detailed algorithmic information may be protected as trade secrets.
  7. I understand that de-identified data may be retained for AI model training after I request deletion of my personal information.
  8. I understand that I may withdraw my consent at any time by contacting [email protected].
  9. I understand that my personal information may be transferred outside Quebec and Canada, and I consent to such transfers subject to appropriate safeguards as required by Law 25 and PIPEDA.
